Quotations

All quotations are based on the information available when the quotation is prepared. This may include photographs, electricity bills, plans, measurements and information supplied by the customer.

Unless the quotation states otherwise:

  • A quotation is valid for the period shown on it.
  • Pricing is subject to product availability and site suitability.
  • The quotation covers only the products and work listed in it.
  • Verbal estimates are not final quotations.
  • Any change requested by the customer may affect the price and completion date.
  • Typographical, calculation or administrative errors may be corrected before the quotation is accepted.

Where the quotation conflicts with these Terms and Conditions, the specific written terms in the accepted quotation will apply to that particular project.

Site assessment

A quotation may be subject to a physical or remote site assessment.

Top One Solar may inspect or request information about:

  • Roof type, pitch, condition and access
  • Building height and layout
  • Shading and panel placement
  • Switchboard and meter condition
  • Inverter and battery location
  • Cable routes
  • Internet access
  • Existing solar or electrical equipment
  • Structural, electrical and safety conditions
  • Scaffolding, lifting or access requirements

If the site conditions differ from the information supplied by the customer, Top One Solar may revise the proposed system, price, scope or installation date.

Standard installation

Where a quotation is based on a standard installation, it generally assumes:

  • Safe and reasonable access to the property
  • A suitable roof and mounting surface
  • A roof that does not require repair or structural work
  • A suitable switchboard and electricity meter
  • Standard cable routes and cable lengths
  • A suitable location for the inverter and other equipment
  • Work completed during normal business hours
  • No hazardous materials or unsafe site conditions
  • No trenching, scaffolding, crane hire or specialist access equipment
  • Installation within Top One Solar’s normal service area

The exact inclusions are those listed in the customer’s written quotation.

Additional and non-standard work

Additional charges may apply where the work requires:

  • Switchboard or meter upgrades
  • Long or concealed cable runs
  • Trenching or underground cabling
  • Scaffolding, cranes or lifting equipment
  • Work on a double-storey or difficult-access property
  • Work on a steep, fragile, damaged or unsuitable roof
  • Roof repairs or structural work
  • Removal or relocation of existing equipment
  • Asbestos-related precautions or specialist work
  • Export-control equipment
  • Internet or communications equipment
  • Changes required by an electricity distributor
  • Work outside normal business hours
  • Travel outside the normal service area
  • Any work not included in the accepted quotation

Where reasonably possible, Top One Solar will explain the additional work and price before proceeding. Urgent safety work may be required where stopping the work would leave the property or electrical system unsafe.

Deposits and payments

The deposit, progress payments and final payment will be shown in the customer’s quotation or invoice.

Unless agreed otherwise in writing:

  • The customer must pay each invoice by its due date.
  • Top One Solar may delay ordering products or scheduling work until the required payment is received.
  • Final payment is due when the contracted work is completed, subject to any payment schedule in the quotation.
  • The customer must not withhold payment for a minor defect that does not prevent the system or service from operating.
  • Any disputed amount must be reported promptly, with the undisputed part paid by the due date.

Top One Solar may suspend work or withhold non-essential documentation while an overdue amount remains unpaid, subject to applicable law.

Customer responsibilities

The customer agrees to:

  • Provide correct contact, property and electricity-account information
  • Disclose known roof, structural, electrical or access issues
  • Provide safe and reasonable access to the property
  • Keep children, pets and unauthorised persons away from the work area
  • Obtain permission from the property owner where the customer is not the owner
  • Obtain any landlord, body corporate, strata or planning approval that is the customer’s responsibility
  • Provide access to the switchboard, meter, roof space and proposed equipment locations
  • Remove obstacles that may prevent the work from being completed
  • Tell Top One Solar about asbestos or other known hazardous materials
  • Maintain internet access where online monitoring requires it
  • Review and approve the system design, equipment and proposed locations where requested

Top One Solar is not responsible for delay or additional costs caused by inaccurate information, unavailable access or approvals the customer was required to obtain.

Installation dates and delays

Installation and service dates are estimates unless expressly confirmed as fixed in writing.

Dates may change because of:

  • Unsafe weather
  • Product or equipment shortages
  • Supplier or freight delays
  • Electricity distributor requirements
  • Approval delays
  • Staff illness or unavailability
  • Unsafe or unexpected site conditions
  • Events outside Top One Solar’s reasonable control

Top One Solar will contact the customer to arrange another suitable date when work cannot proceed as planned.

Product availability and substitutions

Products are subject to supplier availability.

If an agreed product becomes unavailable, discontinued or delayed, Top One Solar may propose a substitute product with reasonably comparable specifications and intended use.

A substitution that materially changes the price or system design will be discussed with the customer before installation.

Product colours, finishes, dimensions and appearance may differ slightly from website images, brochures or samples.

Solar system design and performance

System design and estimated performance may be based on modelling software, available property information, historical weather data and assumptions about shading, orientation and electricity use.

Actual system generation and customer savings may vary because of:

  • Weather and seasonal conditions
  • Roof direction and panel angle
  • Shading, dirt and vegetation
  • Household or business electricity use
  • Grid voltage and network restrictions
  • Equipment efficiency and degradation
  • Electricity prices and feed-in tariffs
  • System shutdowns, faults or maintenance
  • Changes to laws, schemes or retailer policies

Top One Solar does not guarantee a particular electricity bill reduction, feed-in tariff, payback period or level of system generation unless a specific written guarantee is included in the accepted quotation.

STCs and government incentives

Eligible solar installations may create Small-scale Technology Certificates, known as STCs.

Where an STC benefit or discount is included in the quotation, the customer authorises the assignment of the right to create eligible STCs to Top One Solar or its nominated registered agent. Customers commonly assign this right to a registered agent in exchange for an upfront reduction in the system price.

The customer agrees to provide accurate information and sign documents reasonably required for an STC application.

STC eligibility and value may depend on:

  • The installed system
  • Installation location
  • Installation date
  • Scheme requirements
  • Installer and equipment eligibility
  • Certificate market conditions

If the system is not eligible because the customer supplied incorrect information, refused required documentation or changed the installation after approval, the customer may be required to pay the value of the STC discount included in the quotation.

No government incentive, rebate or certificate value is guaranteed unless confirmed in writing.

Solar panel removal and reinstallation

Where Top One Solar removes solar panels for roofing, repair or other work:

  • The customer must disclose known system faults or damage.
  • Removal does not guarantee that existing equipment can be safely reinstalled.
  • Older, damaged or non-compliant components may require replacement.
  • Roof repairs and structural work are excluded unless listed in the quotation.
  • The system may remain switched off until the roof and electrical work are ready for safe reinstallation.
  • New mounting parts, wiring, isolators or electrical work may be required.
  • System performance after reinstallation may differ if the layout or site conditions change.

Damage caused by pre-existing deterioration, brittle components, corrosion or previous installation defects is not treated as damage caused by Top One Solar unless its technicians failed to use reasonable care and skill.

Roof work and existing property conditions

Top One Solar will take reasonable care while working at the property.

The customer acknowledges that roof tiles, sheets, fixings, sealants and electrical equipment may already be aged, damaged, corroded or fragile.

Top One Solar is not responsible for:

  • Pre-existing damage
  • Hidden defects
  • Structural movement
  • Water entry caused by an existing roof defect
  • Damage that could not reasonably have been avoided due to the condition of existing materials

Any roof repair supplied by Top One Solar is limited to the work stated in the quotation.

Bird and pest protection

Bird mesh and pest-protection products are intended to reduce access beneath solar panels. They do not guarantee that all birds, pests, nesting material, debris or related damage will be permanently prevented.

The customer remains responsible for routine property maintenance and for addressing pest activity outside the area covered by the installed product.

Electrical and safety work

Electrical work will be completed by appropriately authorised persons where required by law.

Top One Solar may stop work where it identifies an unsafe condition. The customer may be given a separate quotation for rectification work needed before the contracted service can continue.

The customer must not modify, open, relocate or repair solar, inverter, battery or electrical equipment unless the work is performed by a suitably qualified person.

Inspection and completion

After completing the work, Top One Solar may:

  • Test the installed equipment
  • Provide operating or safety instructions
  • Take installation photographs
  • Supply required certificates or documentation
  • Ask the customer to inspect the completed work

The customer should report visible damage, missing items or concerns as soon as reasonably possible.

A minor outstanding item that does not affect safety or normal operation does not prevent the main work from being treated as completed.

Warranties

Manufacturer warranties may apply to solar panels, inverters, batteries, mounting products and other equipment. Warranty periods and exclusions vary by manufacturer and product.

Any workmanship warranty supplied by Top One Solar will be stated in the quotation, installation agreement or warranty document.

Manufacturer and workmanship warranties are additional to rights that may apply under the Australian Consumer Law. Consumer guarantees apply automatically and cannot be removed by a business’s contract or warranty wording.

Warranty coverage may not apply to problems caused by:

  • Misuse, neglect or accidental damage
  • Unauthorised repairs or modifications
  • Failure to follow operating or maintenance instructions
  • Pest, animal or vegetation damage
  • Fire, flood, storm, lightning, power surge or other external event
  • Internet, retailer, grid or network failure
  • Building movement or roof defects
  • Equipment not supplied or installed by Top One Solar
  • Normal wear and tear
  • A condition excluded by the relevant manufacturer’s warranty

These exclusions do not limit any rights that cannot legally be excluded.

Warranty claims

The customer should provide:

  • Full name and installation address
  • Invoice or quotation number
  • Description of the problem
  • Photographs, videos or error codes where available
  • Date the issue was first noticed

Top One Solar may conduct remote testing, request further information or arrange a site inspection.

A call-out or inspection fee may apply where the issue is not covered by warranty, was caused by another party or relates to equipment not supplied by Top One Solar. The customer will be advised where a fee may apply.

Cancellations and changes

A request to cancel or change an accepted order must be submitted in writing.

The customer may be responsible for reasonable costs already incurred, including:

  • Site assessments
  • Design and administration
  • Applications and approvals
  • Custom-ordered products
  • Supplier cancellation charges
  • Delivery or return costs
  • Work already completed

Any statutory cancellation rights or cooling-off rights available under Australian law will continue to apply.

Top One Solar may cancel or suspend an order if:

  • The site is unsafe or unsuitable
  • Required approvals cannot be obtained
  • Products are unavailable
  • The customer does not make a required payment
  • The customer provides materially inaccurate information
  • The requested work cannot lawfully or safely be performed

Any refund will be calculated after deducting amounts lawfully payable for products, services and costs already incurred.

Customer-supplied equipment

Top One Solar is not responsible for the quality, compatibility, performance or warranty of equipment supplied by the customer unless agreed in writing.

Extra labour or materials required because customer-supplied equipment is incomplete, unsuitable or defective may be charged separately.

Website information

Website content is provided as general information. Product specifications, images, services and availability may change.

Nothing on the website should be treated as a final site-specific design, quotation, financial guarantee or electrical assessment.

The customer should rely on the written quotation and contract prepared for their property.

Privacy

Top One Solar may collect and use customer information to:

  • Prepare quotations
  • Assess and complete work
  • Arrange products and services
  • Submit applications
  • Process payments
  • Provide warranty support
  • Communicate with the customer
  • Meet legal and regulatory requirements

Information may be shared with installers, suppliers, electricity networks, retailers, government bodies, registered agents or service providers where reasonably required to provide the contracted services or meet legal requirements.

Complaints and disputes

Please provide the customer name, property address, quotation or invoice number and a description of the issue.

Both parties agree to make a reasonable attempt to resolve a dispute through direct communication before starting formal proceedings, except where urgent action is required or the customer has a legal right to contact a regulator, tribunal or consumer protection body.

Liability

Nothing in these Terms and Conditions excludes, restricts or changes a consumer right, guarantee, remedy or liability that cannot lawfully be excluded.

To the extent permitted by law, Top One Solar is not responsible for indirect or consequential loss caused by:

  • Electricity retailer pricing
  • Feed-in tariff changes
  • Network restrictions or outages
  • Internet or monitoring-platform failures
  • Delays outside its reasonable control
  • Customer misuse
  • Work performed by another contractor
  • Pre-existing property or equipment defects

This clause does not limit liability where doing so would be unlawful.

Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Changes to these terms

Top One Solar may update its website Terms and Conditions from time to time.

The version applying to a particular project will generally be the version supplied or available when the customer accepts the quotation, unless the parties agree otherwise or a legal change must be applied.

Governing law

These Terms and Conditions are governed by the laws of the Australian state or territory in which the services are supplied.

The parties submit to the courts and tribunals that have jurisdiction in that location.
